ARTICLE 1 – APPLICATION AND MODIFICATIONS OF THE TERMS AND CONDITIONS OF SALE

The terms and conditions of sales apply to all order made on the website: www.select-hydrofoils.com / www.select-fins.com / www.select-kayaks.com / www.select-paddles.com
SM Composite keeps the right to adapt or change at any time the current terms and conditions of sale. In case of modifications, orders will be made under the terms and conditions of sale in effect at the time of order.

ARTICLE 2  – PRODUCT AVAILABILITY

Upon the reception of your order, we verify the availability of the product(s) you ordered.

In case of unavailabilty, we commit within 30 days from the order validation date, either to deliver your order, to let you choose a similar product within the same price range, or to refund you by a bank’s cheque or as with a voucher.

We only put on sale products that are in stock or available to order from our suppliers.

The order validation date corresponds to :

  • The order date in case of online credit card payment.
  • The date of reception of cheques in case of payment by cheque.
  • The date of reception of money transfer in case of payment by money transfer.

In the exceptional out of stock situation on one of the products you ordered, we can ship the other items of your order with your agreement.

Note that the supplier may at any time modify the date of availability of its products. Also note that every items ordered at the same time of your pre-order shall be shipped at the date the pre-ordered product will be available, unless you specify otherwise.

ARTICLE 3 – ORDER VALIDATION AND DIGITAL SIGNATURE

(Law of March the 13th of 2000 on electronic signature)
Every order signed by the consumer with a “double-click” is an irrevocable acceptance that cannot be questioned, within the limits defined in the terms and conditions of sale.
The “double-click” associated with the authentication and non-repudiation processes and the messages’ integrity protection constitue a digital signature. This digital signature acts as a handwritten signature for both parties.

ARTICLE 4 – PRICES

SM Composite keeps the right to modify its prices at any moment but commits to apply tarifs that were given at the time of your order, subject to availability at that date.

ARTICLE 5  – PAYMENT METHOD AND SECURITY

In every case payment is made in Euros.

For a delivery outside of the EEC, billing is made Tax Free.

The shopping basket will automatically take in account if the delivery country is subject to french VAT (20%).

You can pay using :

  • Credit Cards :
    • Payment is made through a secure server.
    • This means that none of your personal banking information goes through SM Composite website
    • Credit card payment is therfore perfectly secured
    • Your order will be recorded and validated as soon as payment has been accepted.
  • Bank Cheque  (only available for french bank account holders, payable to “SM Composite”)
    • Your order is reserved for 7 days.
    • After that period, without receiving your cheque, the order will be cancelled.
    • The order will only be dealt with upon reception of of your cheque and after validation.
  • Money Transfer
    • Your order is reserved for 7  days.
    • After that period, without receiving your money transfer, the order will be cancelled.
    • The order will only be dealt with upon reception of of your money transfer and after validation.

Security :
Your credit card data are encoded using the SSL (Secure Socket Layer) protocol and are never in clear on the net.

SM Composite does not in any case hold these data after the transaction.

Therefore your payment information will be required for each transaction on our website.

Right to property:
Products remain the property of SM Composite until the order amount has been completely cashed by SM Composite

However, from the beginning of shipping, the responsibility of the risks on shipped goods are transferred to the customer.

Payment failure:
SM Composite keeps the right to refuse to deliver or process an order for a customer who would have not fully or partially paid a previous order or with which a payment issue would still be unresolved.

Note: Exchange rates are based on daily variations, displayed prices in other currency than euros on www.sm-composite.com may not take these variation under consideration.

ARTICLE 6 – DELIVERY DURATION AND PROCEDURES

For a delivery in mainland France:
In order to keep track of the parcels, it is not possible for us to deliver in army bases and other premises outside mainland France.

Products are delivered at the delivery address you provided while ordering.
All shipments are insured to the actual value of the items shipped.

We advise you to always check the items at the moment of the reception.

In any case, you have up to 24h to indicate any issue. Word of caution, in case of a problem, please keep the original packaging.
We are not responsible for any delays of delivery due to strikes, natural disasters…

Shipping fees:
For any order delivered in a EEC member state, shipping fees are offered in standard shipping mode.
For customers outside EEC, shipping fees will be calculated by our sales team in the shopping cart.

Delivery time:
The ordered product is delivered through the postal network or by an independent shipping company, depending on the nature of the ordered product, to the discretion of SM Composite to the address provided on the order form.

Delivery time is indicated as from leaving our warehouse.
The delivery mode selection depends on the weight, volume and value of the ordered products.

Parcel at delivery:

You ought to verify the validity of the shipment when delivered and before signing the delivery receipt.
You have to indicate on the receipt any issue (damaged product…) followed by your signature. Verification is considered complete as soon as the customer or any authorised delegate, signed the delivery receipt.
You will also need to indicate by recorded mail the issues with the delivered shipment and confirm to the shipping companies within 3 working days following reception of the items and send a copy of that mail to:

If products need to be returned, a request to our Customer Service must be made within 7 days following delivery.

Any claim received after that delay will not be considered. Returned products will only be accepted in their original packaging (packaging, accessories, manuals…).

If at delivery, the packaging is damaged, torn, opened, you have to verify it contains the entire order and if otherwise write the issue and its nature on the delivery receipt.

We advise you to verify the delivery address on the order summary. In case of mistake on the delivery address, additional shipping fees will be charged to the customer.

ARTICLE 7  – LIABILITIES

SM Composite will not be responsible for not executing the agreed contract in case of, act of god, disturbances or partial or total strikes of especially the postal,shipping and or communication services, floods and fire.

Regarding products purchased for professional use, SM Composite will not be responsible for any indirect damages, business loss, benefit loss or costs that could arise.

The choice and purchase of products or services is the responsibility of the customer.

Total or partial impossibility to use the purchased products due to incompatibilty cannot entitle to refund or make sm-composite.com responsible, unless a defect, of non compliance, unless under the use of the “satisfied or refunded” right as described in article 8.

In case of defect, you have the right to cancel the order or keep the product at a discounted price.

ARTICLE 8  – SATISFIED OR REFUNDED

The customer has 7 working days from the date of delivery, to return any item not satisfied with and ask for an exchange or a refund without any charge apart from the return shipping costs.

You must prior to return your product, to obtain your agreed return number (e.g. article 9, Returning rights). Product must be returned in a good state, in its original package, unused.

ARTICLE 9  – RETURNING RIGHTS

You have 7 days from the time of reception of the order to contact the Customer Service about your request to return the items.

From the date of request to return the item(s) you have 15 days to return them to us.

This condition does not apply in case of a return due to a defect or non-compliance.

A request of return must be made to our Customer Service prior to sending the item(s) back.

Return shipping fee are the responsibility of the customer, unless it is in a case of addressing error from our part. We will then refund you within 30 days the incurring fee based on the shipping cost receipt.

In case of defect, you can either cancel the order or keep the item with a discount after a request has been filed to our Customer Service.

ARTICLE 10 – WARRANTY AND CUSTOMER SERVICES

In order to benefit from warranty on products, it is necessary to keep the purchase receipt.

We remind you that you also benefit from the legal warranty on defects according to french law (articles 1641 and following of “code civil”).

ARTICLE 11  – RIGHTS RELATING TO THE DATA PROTECTION LAW

You are entitled at any moment, to an access, modification and opposition rights to all your personal data according to french law of the 6th of January 1978 on “Informatique et Libertés”, article 34.
